Kristin Cavallari Accuses Jay Cutler of "Marital Misconduct" in Court Documents

Kristin Cavallari and Jay Cutler announced they were splitting after 10 years together yesterday. And now Cavallari has accused Cutler of "marital misconduct" in the court documents she submitted.

Kristin Cavallari and Jay Cutler announced they were splitting after 10 years together yesterday. Rumors that Cutler cheated on Cavallari emerged shortly thereafter. And while a source told People yesterday that infidelity was not the cause of the couple's divorce, Cavallari has accused Cutler of "marital misconduct" in the court documents she submitted.

Entertainment Tonight reviewed the documents. According to the outlet, Cavallari's attorney filed her papers on April 24 in Tennessee and claimed that Cutler "is guilty of such inappropriate marital conduct as renders further cohabitation unsafe and improper." She added that "any misconduct alleged or implied against her in the complaint for divorce was in response to and/or as a result of misconduct on behalf of the Husband."

Marital misconduct, in Tennessee, is a legal term that can be used to describe a variety of situations. Adultery, domestic violence, and verbal, emotional, or physical abuse (or threat of abuse) all fall within the umbrella of what a "marital misconduct" claim covers. Cavallari's documents did not explicitly specify what kind of behavior Cutler allegedly showed.

Cutler was the first to file for divorce. He cited "irreconcilable differences," according to ET, and listed their date of separation as April 21, the same day he filed the documents.

Cavallari listed the date of separation on her documents as April 7.

The outlet notes that, as is standard with Tennessee divorce cases, a temporary restraining order has been filed. That order "prevents Cutler and Cavallari from disposing or concealing marital property, harassing each other and relocating the children," the outlet wrote.

People was told by a source yesterday that the couple's split was because of their incompatibility and breakup has "absolutely nothing to do" with Kelly Henderson (Cavallari's longtime best friend who Cutler was rumored to have cheated with) or rumors of cheating. "Kristin and Jay are a lot different. She has so much on her plate, with her brands and with the show [Very Cavallari]Jay is not as interested in all of that. She's so passionate about her work and they couldn’t relate to each other as much. So it pulled them apart."

Cavallari kept her public statement amicable, writing:

With great sadness, after 10 years together we have come to a loving conclusion to get a divorce. We have nothing but love and respect for one another and are deeply grateful for the years shared, memories made, and the children we are so proud of. This is just the situation of two people growing apart. We ask everyone to respect our privacy as we navigate this difficult time within our family.
